This website is owned and operated by Experiential Journeys Pty Ltd and its successors and permitted assignments, having its principal business place at Experiential Journeys Pty LTD, Suite 5, 242, Hawthorn Road, Caulfield Vic 3161 and a operational office in 20/63, Fairfield Gardens Colombo 8 , Sri Lanka. 

Access to and use of this website/booking engine is conditional upon your acceptance of these terms and conditions. If you do not agree with any part of these terms and conditions, you must not use this website/booking engine.

These conditions apply to all tours/bookings carried out under the auspices of Experiential Journeys Pty Ltd. All prices are quoted in USD /  AUD or the currency visible to your home country. These conditions govern your relationship with Experiential Journeys Pty Ltd. and set out details of Experiential Journey’s obligations in relation to any booking carried out on your behalf. Please read these conditions carefully before making a booking. Any use of the website, or written communication with Experiential Journeys Pty Ltd. for the purposes of travel arrangements, confirms that you are aged 18 or over and that you fully accept these booking conditions.

All information provided by you should be true and accurate and would be treated confidentially.

Holiday/ Tour Contract

Accommodation reservations/ground arrangements made directly through this website, with Experiential Journeys Pty Ltd., whose ABN Number is 19658438807 will become confirmed once you have sent an online confirmation, and paid the total amount due OR any required deposits and when we acknowledge receipt of your full payment OR deposit. In some cases, an initial non-refundable deposit may be charged.

On confirmation of a booking, you are deemed to have entered into a contract the terms of our booking conditions, which are governed by the existing laws in Australia.

Final Payment

If the balance of payment is due for your travel arrangements, the balance payment must be paid by you before 45 days starting the tour.

Methods of Payment

Payments for full or part payment for travel arrangements may be made either by

  1. Bank Transfer or
  2. Credit Card (Visa, MasterCard ) using either PayPal or Stripe

If paid via bank transfer, all additional bank charges and fees related to the transfer will be borne by you.

Payment Schedules

Bookings are done 0 to 45 days before the arrival date, full payment is required.
Bookings are done more than 45 days before the arrival date, a minimum 25% of the payable amount is required. Balance to be paid 30 days prior to arrival.
We reserve the right to cancel your booking in case of non-payment within the stipulated period.

Amendments and Cancellations

While we will use our best endeavours to provide all travel arrangements as confirmed, reasonable changes in the travel arrangements may be made after notifying You.

Cancellation Policy for Normal Bookings
Cancellation Policy

You may cancel your booking at any stage, provided you do so in writing. To protect yourself against this eventuality you should ensure that you purchase travel insurance at the time of booking. In order to meet the administration & logistical costs incurred by us in handling a booking, and to recover at least a percentage of opportunity cost, the following cancellation charges will apply :

  • 30 to 45 Days – 25 % of the tour cost will be charged
  • 14 Days to 29 Days – 50 % of the tour cost will be charged.
  • 8 Days to 13 Days – 75 % of the tour cost will be charged.
  • Less than 7 days no refund.

*Should receive the cancellation in writing.
*Tour start day is not considered for computation of the period.

Cancellation Policy for Special Offers

Cancellations made on special offers could be non-refundable. Please check the offer details.

Cancellation Policy for High Peak Period

Bookings made for or during the ‘High peak’ period (20th December to 10th January ) will be non-refundable.

Cancellation Policy for Amended Bookings

The cancellation policy will be applicable to the original date of arrival and not to the extended date of arrival. If the date of arrival is brought forward, the cancellation policy will be applicable to the amended date of arrival.

Child Policy

Children below 5.99 years- free of charge on existing bedding
Children between 6- 11.99 years (up to a maximum of 02 children) sharing parents’ room- 50% off from the adult rate.

Cancellation by Us

Your booking is very important to us and as such will take all precautions necessary to ensure that your expectations are met; however, we reserve the right to cancel the booking in the event of any unforeseen circumstances, beyond our control and purview. In such an eventuality, we will make arrangements to return all monies paid by you and, wherever possible, offer an alternative tour of comparable type and quality for your consideration. Experiential Journeys Pty Ltd cannot be held liable for any incidental expenses that may be incurred by you during arrangements for a tour that is subsequently cancelled by us under the above terms & conditions.

Our Liabilities & Limitations

All itineraries are sample itineraries, intended to give you a general idea of the likely schedule. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or while on tour. We reserve the right to change any schedule in the interests of the tour participant/s safety, comfort and general well-being.

We shall not be responsible for any delays and alterations in the programme or expenses incurred directly or indirectly due to natural hazards, flight cancellations, and breakdown of transport, weather, sickness, landslides, political instability or any other incidents beyond our control.

We will not be held responsible for any losses incurred, injury or damage to person or property or otherwise in connection with any accommodation, transportation or other services, resulting directly or indirectly from fire, accident, breakdown of machinery & equipment, wars, civil disturbances, strikes, riots, thefts, pilferages, Medical epidemics, customs department regulations, defaults, or any other causes beyond our control.

Our insurance policy does not cover your expenses related to any accident, sickness, loss due to theft, or any other reasons unless our negligence is proven. Visitors are advised to seek such insurance arrangements in their home country. All baggage and personal property at all times are at the client’s risk.
We accept responsibility for ensuring the holidays which you book with us are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

There may be instances where alternative accommodation or services may need to be provided, in such instances we will ensure this is of a similar or superior standard.

Our Nature and Adventure Experiences

We are guided by our own policies involving the community, environment, cultural suitability and sustainable prices that we have developed in line with nationally and internationally acceptable standards.

We aim to educate all stakeholders, including the guests, about the true meaning of ECO -TOURISM.

Booking (Reservation) Disputes

If a dispute arises with regard to a reservation made with Experiential Journeys Pty Ltd., we have the sole authority to cancel the reservation by informing the guest via email. The reservation amount will be refunded in full minus any bank charges to the credit card of the guest.

Health, Passport and Visas

It is your responsibility to ensure that you and other members of your party obtain the right inoculations and medical advice before you travel. Similarly, it is your responsibility to ensure that you and other members of your party have correct and valid passports, visas and have conformed to all other requirements pertaining to your travel arrangements before the holiday commences. Should you require assistance on this matter we will be pleased to make recommendations. We will not be held responsible for your travelling without the correct travel documents.

International and Domestic Air Booking

Reconfirmation of flight bookings is your responsibility. As Travel Arrangements may be booked to connect with international and domestic air flights it is Your or the travellers’ responsibility to keep us updated as to flight times and numbers.

Travel Insurance

You are strongly recommended to take out personal travel insurance, at the time of booking, for all members of your party. It is your responsibility to ensure that the insurance you purchase is adequate. Booking acceptance shall be deemed to include your confirmation that you have taken out such insurance.

Breakages and Damages

You will be responsible for any breakages, losses or damage caused by you or a member of your party during your stay in the accommodation. It is your responsibility to put right the damage or to make full payment to the hotel before departure and to indemnify us against any losses, damages or claims made against us.

Behaviour

You are responsible for compliance with all relevant regulations governing carriage by air or any other mode of transport and your stay during your holiday. If in the opinion of our suppliers/service providers and/or guide representative your behaviour is disruptive or causing distress, injury or danger to other clients, our staff or any other third party, your reservation may be terminated and we shall not be responsible for any costs or claims that are incurred.

Severability

If any of these Booking Conditions are invalid or unenforceable then subject to law, all other provisions of these Booking Conditions shall be and continue to be valid and enforceable.

Complaints

We would wish to resolve amicably any reasonable complaint that we receive relating to the standard of service or accommodation arrangements.
If your complaint cannot be resolved locally you must follow this up by writing a formal complaint letter to us within 28 days of your return home incorporating all other relevant information. It is a condition of this agreement that you communicate any problem relating to the standard of service or accommodation arrangements to the relevant members of Experiential Journeys who are providing services, during the stay. If still not resolved then follow this up with a written complaint. If you fail to follow this simple procedure we cannot accept responsibility as we have been deprived of the opportunity to investigate and rectify the matter.

Experiential Journeys Pty Ltd. does not guarantee that all information available is free from errors or omissions but we will use all reasonable endeavours to correct any errors or omissions once notified of them. Our opinions are our own. Whilst we rigorously strive for accuracy, these opinions are necessarily subjective to some degree.

All recommendations, opinions expressed and prices regarding properties and/or destinations displayed are provided for guidance only. You agree as the user that the use of, or reliance upon, any of the content of the Experiential Journeys website, and in particular any content recommending any accommodation, product or service, is done entirely at your risk. (Including content in subsequent itinerary documents sent to you)

Our website may contain links to websites operated by parties other than Experiential Journeys. Those links are provided to you for your reference and convenience only. We do not own or control the content of those websites and are not responsible for their content or your use of them. We have endeavoured to portray and describe each hotel and/or service as best we can and also to provide the most up-to-date information through our website and other communications with you to the best of our knowledge.

We cannot be held liable for any discrepancies or differences that might arise between the content of our website (text, images etc), and any other 3rd party websites.

IN NO EVENT, Experiential Journeys Pty Ltd., and/or its servants, and/or agents and/or employees be liable for any indirect, incidental, special or consequential damages, loss of profits or revenue, even if such party has been advised of the possibility of such damages or responsible for any injury and/or damage and/or loss and/or impairment suffered and/or caused and/or occasions whatsoever or howsoever due to any reasons accidental other than wilful negligence and/or forbearance of intentionally causing harm by Experiential Journeys Pty. Ltd., and/or its servants and/or agents and/or employees or persons or their personal effects during the activity and/or tour.

Electronic Communication

You communicate with us electronically whenever you visit our website or send emails to us. You consent to receive communications from us electronically. You agree that all notices, disclosures, agreements and other communications that we provide to you electronically satisfy any legal requirements that communications be in writing.

Experiential Journeys Pty Ltd. accepts no liability for any virus or any other type of electronic infection that may be transferred through the site. Under no circumstance will we be liable for any loss or damage caused by a user’s reliance on information obtained through this site.

The copyright and all other Intellectual Property rights in all of the material on this website are owned by Experiential Journeys Pty Ltd. Copying of any part for commercial or business use is strictly prohibited.

Governing Law and Jurisdiction

When your booking is confirmed with us, a contract between Experiential Journeys Pty Ltd. and/or you is constituted. That contract and these Booking Terms and Conditions shall be governed in all respects by the laws of Australia.

Force Majuro

Force Majuro is defined as a situation/condition such as acts of god, storms, fire, war, civil war, military action, government emergency orders, stop-order or strike as well as transportation accident, earthquake, tidal waves etc or other similar events beyond its control. Experiential Journeys shall inform the customer within 24 hours of his inability to perform due Force Majure situation. Once Inform Experiential Journeys shall not be responsible for the non-performance of this contract in case of Force Majuro.

Validity

The above terms and conditions are valid from the 7 th of January 2024.
